NDAs are contracts. Contracts that are used to hide illegal activities are unenforceable by law.

As instruments that only the wealthy can afford and enforce, NDAs should be illegal.

Each NDA is different. And whether they're enforceable or not, when the big guns come after you, the stress and the legal fees are quite a burden.

Contract law is still law. Child trafficking, rape, fraud etc. are not protected by illegal contracts.

I agree that the real issue is the powerful protected perpetrators and their ability to destroy the survivors who come forward.

Like we don't have enough to do these days, but I'd like to pass along both of our messages to a prominent former prosecutor to see if he could go into detail about NDAs. It might help someone to buy time and learn before signing one. Sounds like you might be able to do a write-up, not that I'm giving you work!

My information came from a business law class that I took years ago so I am not qualified to help beyond questioning why NDAs are being used as cover for crimes. They are more of an intimidation tactic it seems.

It would be helpful if an attorney would provide some helpful information about them as a public service announcement.

NDAs and non-competes fell by the wayside a few years ago but seemingly few people are aware of this. I have worked under both several times and when leaving my last job that threatened enforcement of both back in 2024, my legal team assured me they were no longer enforceable in the courtroom. Many organizations still use them even though they know it’s BS, merely a tactic to keep employee’s fearful
